Public offer agreement

1. General provisions

1.1. This offer is the official proposal of the sis.in.ua online store to enter into a distance sales agreement through the online store.

1.2. The buyer fully and unconditionally accepts the seller's offer by placing or paying for an order under this agreement, within the time limits and at the prices stated on the website.

2. Terms and definitions

In this agreement, the following terms have the meanings set out below:

• product means models, accessories, components and related items;
• online store means a facility for presenting or selling products through an electronic transaction;
• seller means the company selling the products presented on the website;
• buyer means an individual who has entered into the agreement with the seller;
• order means the individual products selected by the buyer when placing an order.

3. Subject of the agreement

3.1. The seller undertakes to transfer the product to the buyer, and the buyer undertakes to pay for and accept it under this agreement.

This agreement governs the sale and purchase of products from the online store, including:

• the buyer's voluntary selection of products;
• the buyer placing an order independently;
• the buyer paying for the order;
• processing and delivering the order to the buyer.

4. Placing an order

4.1. The buyer may place an order for any product available on the website.

4.2. Each product may be included in the order in any quantity.

4.3. If a product is out of stock, a manager will notify the buyer by telephone or email.

4.4. If a product is unavailable, the buyer may replace it with a similar product, remove it from the order or cancel the order.

4.5. The seller may offer promotional codes and temporary discounts for all products or selected product groups.

5. Payment procedure

5.1. Payment is made in Ukrainian hryvnias using the method agreed when the order is placed: card transfer, cash on delivery or another available method.

5.2. If payment is not received, the online store reserves the right to cancel the order.

6. Delivery terms

6.1. Products are delivered to carrier branches or parcel lockers, or to an address if that delivery method was agreed when placing the order.

6.2. The buyer receives the documents required by Ukrainian law with the order.

7. Rights and obligations of the parties

7.1. The seller may suspend services if the buyer breaches this agreement.

7.2. The buyer must pay for and receive the order on time.

7.3. The buyer may place an order, enter into an electronic agreement and require the seller to comply with this agreement.

8. Liability of the parties

8.1. The parties are liable for failure to perform or improper performance of this agreement under current Ukrainian law.

8.2. The seller is not responsible for:

• changes made by the manufacturer to a product's appearance;
• minor colour differences caused by display colour reproduction;
• the content or accuracy of information supplied by the buyer when placing an order;
• delivery delays caused by circumstances beyond the seller's control.

8.3. If force majeure circumstances arise, the parties are released from their obligations under the agreement for the duration of those circumstances.

8.4. The parties will make every effort to resolve disagreements through negotiation.

9. Other terms

9.1. The online store reserves the right to amend this agreement, provided that the current version is published on sis.in.ua.

9.2. The buyer is responsible for the accuracy of the information provided when placing an order.

9.3. By placing an order, the buyer consents to the collection, processing, storage and use of personal data for the purpose of fulfilling the order.

9.4. Payment for an order constitutes full acceptance of the terms of the sales agreement.

9.5. Using the online store to preview products and place an order is free of charge.

10. Returning products of proper quality

10.1. Products may be returned under current Ukrainian law and the terms on the Returns and exchanges page.

10.2. The buyer pays the cost of returning a product to the online store.

10.3. When a product of proper quality is returned, the online store refunds the amount paid after receiving the product, taking delivery-related expenses into account.

11. Term of the agreement

11.1. The electronic agreement is considered concluded when the buyer accepts the terms of this public offer.

11.2. Before it expires, the agreement may be terminated by mutual consent before the product is actually delivered.

11.3. Either party may terminate the agreement unilaterally in the cases provided for by current Ukrainian law.

The person responsible for compliance with this agreement on behalf of the online store is Hlib Oleksiiovych Dolzhykov.
